Terms of Use

Capychat is made by Halfwind and operated by Evergoods Holdings LLC (“we” or “us”). You can reach us at hello@halfwind.studio.

If you downloaded Capychat from the App Store, Apple’s Standard Licensed Application End User License Agreement applies together with these terms. If you downloaded it from Google Play, the Google Play Terms of Service also apply to your download and purchases.

Capychat is made for adults. You must be old enough to agree to these terms where you live, and some optional question packs are meant for people 17 and older.

You can use Capychat as a guest or sign in with Apple or Google. Keep your phone and sign-in secure. A guest account lives only on your phone, so if you sign out of it or delete the app before saving it with Apple or Google, it cannot be recovered.

You own the drawings, answers, photos and other things you make in Capychat. You give us permission to store them and deliver them to the person you are paired with, only so the app can work.

Share only what you have the right to share, and don’t use Capychat to send anything unlawful, threatening, harassing or sexually explicit, or anything your partner has not welcomed. You can report your partner’s photo in the app, and you can unpair at any time. We may remove content or suspend accounts that break these terms.

Capychat Plus is an optional auto-renewing subscription, offered weekly or yearly. One subscription unlocks Plus for both partners while you are paired. Prices are shown in the app before you buy.

• Payment is charged to your App Store or Google Play account when you confirm the purchase.
• The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the period ends.
• If you start a free trial, any unused part of it ends when you buy a subscription.
• You can manage or cancel your subscription in your App Store account settings or in Google Play under Payments and subscriptions. Deleting the app or your Capychat account does not cancel it.
• Refunds are handled by Apple or Google under their policies.

Yuzus are an in-app item shared by you and your partner. You earn them for free by using Capychat together, and you can also buy optional yuzu bundles. Yuzus can only be spent on gifts and decor inside Capychat. They have no cash value, cannot be exchanged for money or transferred outside your shared basket, and are used up as you spend them, so they are not restored by Restore purchases. Yuzus are lost if you delete your account. Refunds for bundles are handled by Apple or Google under their policies.

We keep improving Capychat and may change, add or remove features. We may stop offering the app; if we do, we will try to give notice in the app or on this website.

You can stop using Capychat at any time, unpair, or delete your account in Settings (see Delete your account). We may suspend or end access for anyone who breaks these terms or puts other people at risk.

Capychat is provided “as is”. We work to keep it running, but we can’t promise that drawings, boops or notifications will always arrive or that the app will be free of errors. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability is limited to the amount you paid for Capychat in the 12 months before the claim. Nothing in these terms limits rights you have under consumer law that cannot be limited.

We may update these terms. We will post the new version on this page and update the date above. If you keep using Capychat after a change, the updated terms apply.
